On June 14, 2019, in Hilburn v. Enerpipe Ltd., 2019 WL 2479464 (2019), a majority of the Kansas Supreme Court held the noneconomic damage cap in personal injury cases (K.S.A. § 60-19a02) violates Section 5 of the Kansas Constitution. The following is a brief summary of the Hilburn opinion, an analysis of some likely fallout, and suggestions on what should be done by those impacted by this change in Kansas law.
Today, we celebrate Tom Triplett on the occasion of his eightieth birthday. Several of our lawyers were very key to the formation of TWG 34 years ago, but Tom was our leader.
On December 22, 2017, President Trump signed the Tax Cuts and Jobs Act (the “Act”) into law. The Act made significant changes to taxation of individuals and businesses. As the end of 2018 approaches, Attorney Matt Schippers notes several tax provisions for year-end 2018 tax planning.

While attending Washburn, Justin served as Managing Editor for Vol. 55 of the Washburn Law Journal and received the J. Richard Foth and the GNIP GNOP Awards for outstanding legal writing.

Chambers & Partners®, which has been rating the best lawyers in the USA and internationally since 1990, recently released its rankings of law firms for 2018 in 185 different jurisdictions. TWG and its partners were again among lawyers noted in the top tiers in several of the firm’s strongest practice areas. For 2018, TWG was ranked in the top tiers of Chambers ranking in the practice areas of Litigation, and General Commercial Real Estate. (Chambers USA 2018).
Construction begins. Construction crews arrived Monday night April 16 as the TWG office transformation began. The anticipated remodel is part of an overall larger project which will transform not only the TWG office, but the entire entrance to the Terra Cotta Tower, as well.
A Wichita-based transportation company found itself named as a defendant in a lawsuit brought by a former employee. The employee, who had suffered a groin injury and received workers’ compensation benefits, claimed that the company had fired him in retaliation for his claim. The transportation company hired Triplett Woolf Garretson, LLC to defend the lawsuit.
No good deed goes unpunished.
TWG represented a physician who agreed to help a former medical school classmate obtain a medical license under a program known as a preceptorship. The physician hoped the former classmate once licensed, would be able to join his practice, but during the process realized the classmate did not meet the physician's standards. Upon completion, a Kansas license was obtained, but no job was offered. The former classmate then sued the physician and his practice alleging a breach of some employment agreement and seeking damages.
TWG was engaged to defend a local technology company against an electronics technician they had contracted to integrate hardware and software components into a wireless fluid management system. The system did not perform as intended and the relationship soured. The independent contractor sent a demand letter to the company alleging their relationship was a “joint venture.” During expert testimony it was revealed the contracted technician was using a third-party software and claiming it as his own.
A summary of the New Tax law effective 2018. On December 22, 2017, President Trump signed into law the Tax Cuts and Jobs Act (the “Act”), the largest tax reform since 1986. Most of the Act’s provisions became effective January 1, 2018. TWG has prepared a summary of how the changes can benefit individuals and businesses.

In 2015, a TWG client Homeowner in Maize, Kansas hired a Contractor to repair hail damage to her home. The work was not performed to the Homeowner’s satisfaction, yet the Contractor threatened to put a lien on the client’s home if she did not pay for the work and threatened to sue her to foreclose on her home.
Amy Fellows Cline of TWG filed suit on behalf of the Homeowner and ultimately tried the case before a twelve person jury this past July. After a four-day trial, the jury found for the Homeowner and awarded 100% of the requested damages to TWG’s client.

Triplett received his LL.M. from New York University, and Ross E. Hellwig received his LL.M. from the University of Florida College of Law.

Recently, AR Nebraska Investment, LLC sold a large warehouse building located in a suburb of Omaha, Nebraska. It was the last George Ablah property to be sold closing out an era that saw George closing deals and developing millions of square feet in his lifetime. The building was originally purchased in 2011 by that entity, the members of which were George J. Ablah, Ronald D. Ryan and Frank A. Mills.

Congratulations to Bill Warren and Mark and Andy Hutton on the sale of all of the Warren Theatres! Bill conceived, designed, built and operated the theatres in a manner that has set a high nationwide standard for the movie theatre industry. The purchaser is Regal Entertainment Group which operates one of the most geographically diverse theatre circuits throughout the United States and beyond. Every indication is that Regal will carry on the outstanding tradition established by Bill Warren.

The Kansas Court of Appeals recently affirmed a judgment secured by Derek S. Casey of Triplett Woolf Garretson upholding an elderly gentlemen’s estate plan against his daughter’s accusations that he was mentally incompetent and subjected to undue influence.
